  • identification data, which means in particular name, surname, title, date of birth, address of permanent residence, nationality;
  • contact details, which include in particular a contact address, a telephone number and an e-mail address;
  • data related to the performance of work, information about your qualifications (mainly education and professional qualifications) and completed training, information about the ability to perform work;
  • information about your state of health necessary to fulfill the legal obligations of the employer (initial medical examination, psychological examination), information about physical disability,
  • the information provided in the CV, job application and cover letter that you have provided to us on the basis of a competition for a job or voluntarily outside the competition;

Purposes of personal data processing:

  • processing, it is necessary that, at the request of the data subject, measures are taken before the conclusion of the employment contract (pre-contractual relationship) (including agreements on work performed outside the employment relationship) (hereinafter the “contract”) to be concluded between the a person as an employee of the operator;
  • processing is necessary to fulfill the legal obligations of the operator as an employer (eg human resources and wages, safety and health at work, occupational health service, etc.), which result in the operator mainly (but not only) from the following legislation:
    • Act no. 311/2001 Coll. Labour Code;
    • Act no. 395/2002 Coll. on archives and registries;
    • Act no. 124/2006 Coll. on safety and health at work;
  • processing is necessary for the purposes of the legitimate interests of the controller, in order to:
    • the protection of our legal claims (in other words, so that we can defend our own legal claims in judicial, extrajudicial or enforcement proceedings), where our legitimate interest is to prevent damage;
    • ensuring the security and protection of property, where our legitimate interest is to ensure physical and IT security as well as the protection of our property; for this purpose, we can monitor certain areas in the workplace and the use of electronic devices, information systems and IT infrastructure;
  • processing on the basis of your consent for the purpose of:
    • records of job seekers outside the competition;

Legal basis for the processing of personal data:

  • 6 par. 1 letter a) GDPR – processing is on the basis of expressed consent to the processing of personal data;
  • 6 par. 1 letter b) GDPR – processing is necessary for the performance of the contract concluded between the controller and the data subject according to point 1.5.1 of this Information;
  • 6 par. 1 letter c) GDPR – processing is necessary to fulfill the legal obligations arising from the relevant legal regulations;
  • 6 par. 1 letter f) GDPR – processing is necessary for the purposes of the legitimate interests of the controller according to point 1.5.3. this Information;

The operator provides your personal data in particular to the following recipients / categories of recipients:

  • processor of personnel and payroll, registry, processing and storage of operator’s documents;
  • camera system operator;
  • legal service provider;
  • providers of information systems and technical infrastructure when managing internal personal data management systems;

The operator is entitled to keep personal data for the following period:

  • for the duration of the pre-contractual relationship with the person concerned;
  • for the time necessary to exercise the rights and obligations arising from the pre-contractual relationship with the person concerned;
  • for the duration of the limitation or prescription periods in relation to claims arising out of or relating to the pre-contractual relationship with the person concerned;
  • for the duration of the judicial, administrative or other proceedings to the extent necessary for the entire duration of such proceedings and the remainder of the limitation or prescription period after their termination;
  • for the purposes of point 1.5.2. this Information for the period resulting from the relevant legislation;
  • for the purposes of point 1.5.3. as long as we have your consent to the processing of personal data;

Identification of the rights of the data subject:

  • the right of access to personal data concerning the data subject;
  • the right to rectify the personal data of the data subject;
  • the right to delete personal data of the person concerned;
  • the right to limit the processing of personal data of the person concerned;
  • the right to object to the processing of the personal data of the person concerned, in particular to object to the processing according to point 1.5.1. this Information; In such a case, we will not further process your personal data for the given purpose, unless we have the necessary legitimate reasons for continuing such processing;
  • the right to portability of personal data of the person concerned;
  • the right to file a complaint with the Office for Personal Data Protection, Slovak Republic;

Existence of the right of the affected person to withdraw consent to the processing of personal data at any time

The operator informed the affected person when the affected person gave his consent that he has the right to withdraw this consent to the processing of his personal data at any time, by sending an e-mail to the e-mail address info@lemontrade.sk or in writing to the address of the company headquarters, indicating which personal data it concerns data for which consent to their processing is revoked;

Information on whether the provision of personal data is a legal or contractual requirement, or a requirement that is necessary to conclude a contract (including information on whether the data subject is obliged to provide personal data and the possible consequences of not providing it):

  • in the case of processing personal data for the purpose according to point 1.5.1 of this Information, the provision of personal data and their processing by the operator is necessary for the performance of the contract (if the person concerned does not provide personal data, the operator would not be able to conclude an employment contract);
  • in the case of processing personal data for the purpose according to point 1.5.2 of this Information, the processing of personal data about the affected person by the operator is necessary to fulfill the legal obligation of the operator resulting from generally binding legal regulations;
  • in the case of processing personal data for the purpose according to point 1.5.3 of this Information, the person concerned is not obliged to provide personal data and is entitled to object to the processing of his personal data (in the event that you use your right to object to the processing of your personal data according to point 1.5. 3 of this Information, we will not further process your personal data in such a case, unless we have the necessary legitimate reasons for continuing such processing);
  • in case of processing personal data for the purpose according to point 1.5.4. of this information, the person concerned is not obliged to provide personal data and is entitled to give his consent according to point 1.5.4. withdraw at any time (if you use your right to withdraw your consent to the processing of your personal data, we will not process such data about you)

We obtain the most personal data directly from you by providing us with your CV, job application and motivation letter and filling out the relevant form. We may also obtain information about you from third parties in the form of references.
